DMCA Policy

Apple Pie Overnight Oatmeal respects the intellectual property rights of others and expects its users to do the same. This policy describes our procedures for responding to alleged copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA).

Filing a DMCA Notice of Infringement

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the Apple Pie Overnight Oatmeal website or service, please notify our designated Copyright Agent by providing the following information in writing:

  1. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest.
  2. A description of the copyrighted work that you claim has been infringed, including the URL (i.e., web page address) of the location where the copyrighted work exists or a copy of the copyrighted work.
  3. Identification of the URL or other specific location on the Apple Pie Overnight Oatmeal service where the material that you claim is infringing is located.
  4. Your name, address, telephone number, and email address.
  5. A statement by you that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Filing a DMCA Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you may send a counter-notification to our designated Copyright Agent. Your counter-notification must be in writing and contain the following:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  • A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Apple Pie Overnight Oatmeal may be found, and that you will accept service of process from the person who provided the original notification of infringement or an agent of such person.
